ASBA's take on SB1062 and Small Business in Arizona.

As most of you have heard, the Arizona Legislature passed a bill (SB1062) called the Exercise of Religious Rights.  Below is a letter we sent to governor Brewer asking her to veto the legislation.  ASBA is just one of dozens of business groups to oppose the bill. Dear Governor Brewer,

On behalf of the Arizona Small Business Association (ASBA) and our more than 10,000 member business owners, I am writing to inform you that we oppose SB1062 and strongly urge you to veto the Exercise of Religion; State Action bill. The Arizona Small Business Association supports and strongly defends the First Amendment of the United State Constitution. Although SB1062 intends to protect religious freedom, there are consequences to this legislation that we are very concerned with.

First, SB1062 would unintentionally expose private sector businesses and business owners to liability by allowing an employee to exercise their own religious beliefs at the expense of the business. SB1062 would shift the balance of control from the business owner to employees who can decide to refuse someone's business based on their own personal religious beliefs and not the business owners. As a result, the business and its owner(s) would be held liable for an employee's actions because of their religious convictions.

We also believe that such a law would be very damaging to Arizona from both a perception, and economic development standpoint. In this highly competitive and global economy, such a law would be a significant step backwards for Arizona. Finally, SB1062 could expose the State of Arizona to legal action by raising the question if such a law is constitutional. For these reasons, we ask that you veto SB1062.
