Required Benefit Plan Documents & WRAP Summary Plan Description (SPD) ~ All employers who offer Group Welfare Benefits to their employees are required to provide a Plan Document and Summary Plan Descriptions (SPDs). BASIC will provide an ERISA-compliant Plan Document & WRAP Summary Plan Description (SPD) for required benefit plans meeting regulatory compliance requirements.

Required Summary of Material Modification (SMM) ~ ERISA requires that plans provide a Summary of Material Modification (SMM) to plan participants when there is a material modification to the plan itself, or there is a change to the information that is required to be provided in the Summary Plan Description (SPD).Required ERISA / PPACA Model Notices ~ Employers are required to give employees a variety of notices concerning their rights and responsibilities.

  • Medicare Part D Notice of Creditable or Non-Creditable Coverage

  • Children’s Health Insurance Program Reauthorization Act (CHIPRA)

  • Summary of Benefits and Coverage

  • Patient Protection Notice

  • Other Model Notices May be Required

Recommended Notices & Forms ~ If you have not provided these notices in the past

  • Wellness Program Disclosure (Only if you provide a Wellness Plan)

  • HIPAA Notice of Privacy

  • Newborns’ Act Disclosure

  • General Notice of Pre-Existing Condition

  • Group Health Plan Pre-Existing Exclusion Waiver (*only required if waiver was requested and received from the Department of Health & Human Services [HHS]).

  • Other Model Notices May be Required

Non-Discrimination Testing* ~ Separate fee per health plan.

PCORI Research Fee (Form 720)* ~ If you have an HRA and in some cases a Flex plan, likely you (as an employer) will have to pay the PCORI Fee ($2.00 per employee) and file Form 720. BASIC will consult and complete Form 720.
